This book presents a collection of essays on institutional theory written by the German sociologist and Weber-expert M. Rainer Lepsius. Based on Weber's work, the author develops concepts of institutional theory, which he subsequently applies to topics such as National Socialism, democratization processes, German unification, and the institutionalization of the European Union. By showing how charismatic leadership can under certain circumstances threaten democratic structures and curtail individual freedoms, and by analyzing the structural and cultural conditions under which people develop (...) trust in political and social structures and ultimately come to support and comply with them, the author provides a sound analytical understanding of the development of democratic institutions and a democratic political culture. Sind die Menschenrechte primär Ausdruck einer politischen Praxis und die Idee der Menschenrechte eine Art „Überbau“, den die Praxis epiphänomenal hervorbringt? Oder ist die Praxis der Menschenrechte das Ergebnis der Verwirklichung einer normativen Idee, die unabhängig von ihr existiert? Ist die Idee der Menschenrechte die Bedingung dafür, dass es die Praxis der Menschenrechte geben kann? Oder gibt es einen Vorrang der Praxis vor der Idee? In meinem Aufsatz argumentiere ich für zwei These: 1. These: Menschenrechte sind prinzipiell unabhängig von jeder (...) bestehenden rechtlichpolitischen Praxis und sind zugleich untrennbar an bestimmte rechtlich-politische Praktiken geknüpft. Darin besteht der konstitutive Widerspruch der Menschenrechte. 2. These: Aus diesem Widerspruch folgt nicht, dass wir aufhören sollten über Menschenrechte nachzudenken und eine Politik der Menschenrechte anzustreben. Der Widerspruch hat keine lähmende Wirkung, sondern ist theoretisch und praktisch produktiv. Um diese Thesen zu plausiblisieren, werde ich zunächst einige Grundzüge von Arendts Diskussion der Menschenrechte rekapitulieren (Abschnitt 2) und ihr Postulat eines den Menschenrechten vorgelagerten „Rechts, Rechte zu haben“ diskutieren (Abschnitt 3). Ausgehend von einer kritischen Diskussion der diskurstheoretischen Weiterentwicklung von Arendts These zu einem „Recht auf Rechtfertigung“ im diskurstheoretischen Konstruktivismus von Seyla Benhabib und Rainer Forst (Abschnitt 4) werde ich einen rechtfertigungstheoretischen Dekonstruktivismus vorstellen, der das Verhältnis von Praxis und Idee der Menschenrechte als produktiven Widerspruch fasst (Abschnitt 5). Der Aufsatz beschäftigt sich am Beispiel des deutschen "Kopftuchstreits" mit der rechtlich-politischen Auseinandersetzung um subjektive Rechte innerhalb des liberalen Rechtsstaats. Wie Christoph Menke in seiner Deutung der für den politischen Liberalismus wesentlichen politischen Konflikte gezeigt hat, bezieht sich diese Auseinandersetzung vorrangig auf zwei Fragen: Wer sollte Anspruch darauf genießen, ein politisches Subjekt zu sein, das heißt, als Gleiche oder Gleicher berücksichtigt zu werden? Welche Ansprüche politischer Subjekte könneen als schützenswerte Verwirklichung subjektiver Rechte gelten? Der vorliegende Beitrag beschäftigt sich vorwiegend mit (...) der Frage, wie die politischen Konflikte des letztgenannten Typs auf die rechtliche Auseinandersetzung um Grundrechte abfärben. Damit wende ich mich gegen ein Verständnis der Grundrechte, das diese als Garant der ethischen Neutralität eines liberalen Gemeinwesens ansieht. Ich möchte zeigen, dass der Sinn subjektiver Rechte in der liberalen Demokratie zwar unter anderem genau darin besteht, dass sie partikulare ethische Wertvorstellungen neutralisieren und die Bürgerinnen und Bürger innerhalb eines vernünftigen Rahmens vor Unterdrückung schützen. Wie eine Analyse der Entscheidungen des Bundesverfassungsgerichts (BVerfG) zum "Kopftuchstreit" zeigt, wird diese Funktion aber stets zugleich durch die partikulare Interpretation gleicher Rechte unterminiert. Dies bezeichne ich als die Dekonstruktion der Neutralität, die sich im Recht vollzieht. (shrink)

Kant’s formula of universal law (FUL) is standardly understood as a test of the moral permissibility of an agent’s maxim: maxims which pass the test are morally neutral, and so permissible, while those which do not are morally impermissible. In contrast, I argue that the FUL tests whether a maxim is the cause or determining ground of an action at all. According to Kant’s general account of causality, nothing can be a cause of some effect unless there is a law-like (...) relation between the putative cause and effect. Applied to the case of action, no maxim can be the cause of an agent’s action unless there is a law-like relation between maxims of that kind and actions of that kind. The special capacity to act according to maxims as law-like causes is what Kant calls a will; the basic constitutive principle of the will is a non-normative principle I call the categorical declarative. While the actions of a perfectly good will would be described by the categorical declarative alone, human action is determined not only by the causality of the will, but also by competing causes, namely those stemming from inclination. There is thus need for a causal test for putative maxims. The test contained in the FUL is meant to determine whether an action could be grounded solely on the agent’s maxim, or whether it requires a cause external to the will. This account permits one to build eventual distinctions concerning the morality of actions on prior and independent distinctions concerning their causality. (shrink)

The ancient Greeks subscribed to the thesis of the Unity of Virtue, according to which the possession of one virtue is closely related to the possession of all the others. Yet empirical observation seems to contradict this thesis at every turn. What could the Greeks have been thinking of? The paper offers an interpretation and a tentative defence of a qualified version of the thesis. It argues that, as the Greeks recognized, virtue essentially involves knowledge ? specifically, evaluative knowledge of (...) what matters. Furthermore, such knowledge is essentially holistic. Perfect and complete possession of one virtue thus requires the knowledge that is needed for the possession of every other virtue. The enterprise of trying to reconcile the normative view embodied in this conception of virtue with empirical observation also serves as a case study for the field of moral psychology in which empirical and normative claims are often deeply and confusingly intertwined.1. This 2005 book is a critical examination of Michel Foucault's relation to ancient Greek thought, in particular his famous analysis of Greek history of sexuality. Wolfgang Detel offers an understanding of Foucault's theories of power and knowledge based on modern analytical theories of science and concepts of power. He offers a complex reading of the texts which Foucault discusses, covering topics such as Aristotle's ethics and theory of sex, Hippocratic dietetics, the earliest treatises on economics, and Plato's theory of love. Der Forschung gelaufig ist die Rede von einer ersten (5./4. Jh. v. Chr.) und der sog. Zweiten Sophistik (2. Jh. n. Chr). Aber auch die Literatur des Hellenismus und der fruhen Kaiserzeit kennt zahlreiche Sophisten. Der Sophist, verstanden als (schlechter) Lehrer und Redner, Gegenspieler des Philosophen oder Vertreter der griechischen Bildung, bildet deshalb den Dreh-und Angelpunkt der Beitrage, die Schlaglichter auf Orte, Methoden und Personen der Bildungsvermittlung werfen. Evolutionary change is opportunistic, but its course is strongly constrained in several fundamental ways. These constraints (historical/phylogenetic, functional/adaptive, constructional/morphogenetic) and their dynamic relationships are discussed here and shown to constitute the conceptual framework of Constructional Morphology. Notwithstanding recent published opinions which claim that the discovery of constraints renders Neodarwinian selection theory obsolete, we regard the insights of Constructional Morphology as being entirely consistent with this theory. As is shown here in the case of the Hyracoidea, formal analysis of the constraints (...) which have framed the evolution of various characters extends our understanding of the evolution of a taxon. The semantics of natural kind terms has recently been seen as a problem of reference. Kripke and Putnam have suggested that their meaning begins with rigid designation, with any further implications emerging after empirical study. I part ways with this approach and instead offer an account that focuses on the contribution that these terms make to the inferential roles of different sorts of sentences. I note that natural kind terms play an odd array of grammatical roles, both as subject and (...) as parts of predicates, and explain why this dual role contributes something pragmatically significant to explanations of natural phenomena. It is shown in a literature review, that in the Typostrophic Theory autonomous mechanisms in the organism are considered as the factors which play a decisive role in orienting and controlling the evolutionary process. Selection is a controlling factor of only minor importance. The Synthetic Theory, on the other side, says that phylogenetic changes are not random or controlled by “internal factors” but can always be considered as adaptive remodellings. They are achieved by selection acting on the variation within populations. (...) Ecological, historical and “bautechnische” factors are considered as limiting mechanisms in the evolutionary process. Prof. Dr. Frieder Otto Wolf, President of the Humanistischer Verband Deutschlands, provides an overview of the main currents of modern humanism in Germany. He describes the central stream of German humanism as practical, in that it combines the principled imperative to overcome all structures and situations in which people are not treated as human beings with seeking to widen the horizons of humane existence in the arts and sciences and in capabilities of leading a fulfilling life. This humanism compels (...) resort to other criteria than nature, such as those logical, emotive, cultural, in order to gauge the acceptability of value claims. The practical efforts to humanize society and widen human horizons requires engagement in public policy debates and social organizing and programming on consensus issues. Accordingly, the HVD works on such diverse issues as strengthening the rights to bodily integrity and sexual autonomy, preventing economic collapse, accommodating immigrants, protecting personal privacy, limiting the use of military force, building intra- and international peace, and exposing anti-humanist prejudice. We investigate the epistemological consequences of a positive polymerase chain reaction SARS-CoV test for two relevant hypotheses: V is the hypothesis that an individual has been infected with SARS-CoV-2; C is the hypothesis that SARS-CoV-2 is the cause of flu-like symptoms in a given patient. We ask two fundamental epistemological questions regarding each hypothesis: First, how much confirmation does a positive test lend to each hypothesis? Second, how much evidence does a positive test provide for each hypothesis against its negation? (...) We respond to each question within a formal Bayesian framework. We construe degree of confirmation as the difference between the posterior probability of the hypothesis and its prior, and the strength of evidence for a hypothesis against its alternative in terms of their likelihood ratio. We find that test specificity—and coinfection probabilities when making inferences about C—were key determinants of confirmation and evidence. Tests with 8) for V against ¬V regardless of sensitivity. Accordingly, low specificity tests could not provide strong evidence in favor of C in all plausible scenarios modeled. We also show how a positive influenza A test disconfirms C and provides weak evidence against C in dependence on the probability that the patient is influenza A infected given that his/her symptoms are not caused by SARS-CoV-2. Our analysis points out some caveats that should be considered when attributing symptoms or death of a positively tested patient to SARS-CoV-2. (shrink)

The story of Sosipatra of Pergamon (4th century C.E.) as told by her biographer, Eunapius of Sardis in his Lives of the Philosophers and Sophists, is a remarkable tale. It is the story of an elite young girl from the area of Ephesus, who was educated by traveling spirits (daemons), and who grew up to lead her own philosophy school on the west coast of ancient Asia Minor. She was also a prophet of sorts, channeling divine messages to her students, (...) family, and friends, capable of mentally viewing events that were happening in other locations, and foretelling the future. This volume is the first sustained, book length, attempt to tell the story of this mysterious woman. It presents a rich contextualization of the brief, sketchy, and highly fictionalized portrait provided by Eunapius. (shrink)

Spiritual Taxonomies and Ritual Authority recounts how philosophers of the late third century C.E. organized the spirit world into hierarchies, positioning themselves as high priests in the process. By establishing themselves as experts on sacred matters, they fortified their authority, prestige, and reputation.

In his book Welfare and Rational Care, Stephen Darwall proposes to give an account of human welfare. Or rather, he offers two accounts, a metaethical and a normative account. The two accounts, he suggests, are somewhat supportive of each other though they are logically independent.

In his book “Medical Philosophy: Conceptual issues in Medicine”, Mario Bunge provides a unique account of medical philosophy that is deeply rooted in a realist ontology he calls “systemism”. According to systemism, the world consists of systems and their parts, and systems possess emergent properties that their parts lack. Events within systems may form causes and effects that are constantly conjoined via particular mechanisms. Bunge supports the views of the evidence-based medicine movement that randomized controlled trials (RCTs) provide the best (...) evidence to establish the truth of causal hypothesis; in fact, he argues that _only_ RCTs have this ability. Here, we argue that Bunge neglects the important feature of patients being open systems which are in steady interaction with their environment. We show that accepting this feature leads to counter-intuitive consequences for his account of medical hypothesis testing. In particular, we point out that (i) the confirmation of hypotheses is inherently stochastic and affords a probabilistic account of both confirmation and evidence which we provide here; (ii) RCTs are neither necessary nor sufficient to establish the truth of a causal claim; (iii) testing of causal hypotheses requires taking into account background knowledge and the context within which an intervention is applied. We conclude that there is no “best” research methodology in medicine, but that different methodologies should coexist in a complementary fashion. (shrink)

To many who develop and use free software, the GNU General Public License represents an embodiment of the meaning of free software. In this paper we examine the definition and meaning of free software in the context of three events surrounding the GNU General Public License. We use a case involving the GPU software project to establish the importance of Freedom 0 in the meaning of free software. We analyze version 3 of the GNU General Public License and conclude that (...) although a credible case can be made that the added restrictions are consistent with the definition of free software, the case requires subtle arguments. Strong arguments against the added restrictions are less subtle, and may therefore be more convincing to many users and developers. We also analyze the Affero General Public License and conclude that it is inconsistent with the definition of free software. (shrink)

Pp. xliv q- 456.) This new edition of selections from Pierre Bayle's famous Dictionnaire will be welcomed by historians and philosophers alike. In it we find a representative sample from the book that was both the inspiration and despair of much of eighteenth-century thought, and that still presents modem man with both questions and methodological acid that makes it difficult to find or accept "truth." The young readers who will meet Pierre Bayle for the first time in these pages will find him to be the skeptical philosopher, the ribald, sometimes lewd, even pornographic storyteller, the detached scholar who prowled through the history and the ideas of men, dissolving all certainty by analyses that peeled off layer after layer of belief until the core itself was exposed as naive or ridiculous. Had Professor Popkin done nothing more than provide us with these excellently chosen selections from the Dictionnaire, we would all be in his debt, for he gives us a chance easily to bring this important work to the attention of our students. But this volume is considerably more than simply a selection. Professor Popkin's Introduction is an important statement in the controversy over Bayle's personal beliefs and involvemeat. For more than two decades a large literature has portrayed Bayle in many different guises: for some he was still the skeptic who intentionally forged the weapons with which Voltaire and his colleagues assaulted the Judeo-Christian traditions of European men; at the other extreme he was a devout Huguenot who merely wanted to do for the Calvinist world what Bishop Huet and other Catholic skeptics did for the Catholic one, namely to prove the necessity of accepting the Christian beliefs on faith since absolute knowledge was impossible. Professor Popkin has learned Bayle's methodology too well to allow himself to be trapped by a simple explanation. He refuses to identify Bayle with a Kierkegaard or a Lamennais whose ideas would dissolve under Bayle's pen just as did Pascal's and Jurieu's. But where are we to find the secret of this man who lived out his life as a member of the French Reformed Church in Amsterdam while he unfolded the absurdity or naivet~ of every intelligible Christian theology? The problem becomes more perplexing when we note his obvious sympathy for both Manicheanism and Judaism. Could he have been the last of the Cathars or a secretly converted Jew? Popkin calls attention to Bayle's interest in and affection for Maimonides' work which he translates "Guide for the perplexed", but which could be translated "Guide for those who have lost their way" or in our parlance, "the derailed." In a way Bayle's Dictionnaire was itself a "Guide" for men in trouble with their beliefs. But Bayle's approach to this problem must be understood in light of his own discussion of religion "of the heart" and religion "of reason." Like Madame Labrousse, Popkin is much impressed by the simplicity of Bayle's last words, written on the day he died, in which he described himself as "a Christian philosopher convinced of and pierced with the mercies of God.... " The statement omits all the im~ portant theological propositions of Christian theology as well as any emotional feeling. We must see Pierre Bayle as an erudite, unemotional man whose "religion had no expressed or expressible content.., but was only in the heart in some quiet unemotional way.... " Popkin sees him as "a quite Erasmian scholar, living out his days in the city of Erasmus, examining man's intellectual heritage and intellectual world.., by patient erudition [undermining] man's intellectual frame of reference while remaining secure and tranquil in his unemotional religion of the heart."
